CAPITAL GAINZ FITNESS
By purchasing, enrolling in, or participating in services provided by Capital Gainz Fitness, the client acknowledges and agrees to the following terms and conditions.
1. SERVICES
Capital Gainz Fitness offers services that may include in-person personal training, online fitness coaching, customized workout programming, nutrition coaching and meal-planning guidance, progress tracking, body-composition monitoring, accountability, and access to a training app.
Services provided will depend on the program or package purchased by the client.
2. PAYMENTS
All program fees and training fees are due according to the payment arrangement established at enrollment. Payments may be processed electronically through Capital Gainz Fitness’s designated payment processor.
Prices and program offerings may change. Any applicable pricing and payment terms will be communicated to the client.
3. CANCELLATIONS & RESCHEDULING
Clients should provide at least 24 hours’ notice when canceling or rescheduling an in-person training session.
Sessions canceled with less than 24 hours’ notice or missed without notice may be counted as a completed session, except when Capital Gainz Fitness determines that an exception is appropriate due to an emergency or other circumstances.
If Capital Gainz Fitness needs to cancel a session, the session will be rescheduled or otherwise credited as appropriate.
4. REFUNDS
Because coaching services involve reserved training time, individualized programming, planning, and ongoing support, payments for services already provided are generally non-refundable.
Any request involving unused prepaid services will be reviewed according to the client’s specific circumstances and any applicable law.
5. ONLINE COACHING & TRAINING APP
Online coaching clients may receive workouts, instructions, progress tracking, check-ins, nutrition guidance, and other coaching resources through Capital Gainz Fitness’s training platform/app.
Clients are responsible for following exercise instructions carefully, using appropriate equipment, selecting a safe training environment, and communicating any problems, pain, injuries, or limitations that could affect their training.
Access to the coaching platform may end when a client’s paid coaching program ends.
6. EXERCISE & ASSUMPTION OF RISK
Physical exercise involves inherent risks, including soreness, strains, falls, injury, cardiovascular events, and other potential complications.
Clients are responsible for determining whether they are physically able to participate and should obtain appropriate medical clearance when necessary. Clients agree to communicate relevant limitations or changes that may affect safe participation.
Participation in exercise and fitness activities is voluntary, and clients acknowledge the inherent risks associated with physical activity.
7. NUTRITION GUIDANCE
Nutrition services provided by Capital Gainz Fitness are intended for general fitness, wellness, and educational purposes within the coach’s professional scope.
Nutrition coaching is not medical diagnosis or treatment and is not a substitute for individualized care from a physician, registered dietitian, or other appropriately licensed healthcare professional when such care is needed.
8. LAB WORK & HEALTH INFORMATION
If a client voluntarily provides laboratory results or other health information, Capital Gainz Fitness may use that information to better understand the client’s overall fitness and wellness goals within the appropriate scope of coaching.
Capital Gainz Fitness does not diagnose medical conditions, prescribe medications, alter medical treatment, or represent fitness coaching as medical care. Questions concerning abnormal laboratory results, medical conditions, medications, or treatment should be addressed with an appropriately licensed healthcare professional.
9. BODY COMPOSITION & PROGRESS TRACKING
Capital Gainz Fitness may use measurements such as weight, body-fat estimates, muscle-mass estimates, circumference measurements, photographs, performance data, and other fitness metrics to monitor progress.
Body-composition devices and similar tools provide estimates and may vary based on hydration, food intake, time of day, device characteristics, and other factors.
10. RESULTS
Capital Gainz Fitness is committed to providing individualized coaching, education, programming, and accountability. However, individual results vary and cannot be guaranteed.
Results depend on numerous factors, including consistency, nutrition, exercise adherence, recovery, lifestyle, individual physiology, and other circumstances.
11. CLIENT RESPONSIBILITY
Successful coaching requires participation from both the coach and client. Clients are expected to communicate honestly, follow agreed-upon programming to the best of their ability, attend scheduled sessions, complete check-ins when applicable, and inform Capital Gainz Fitness when circumstances change.
12. PRIVACY
Personal information, progress information, photographs, body-composition information, and health information provided by clients will be handled with appropriate care. Client photos, testimonials, or identifiable progress information will not be used publicly without appropriate permission.
13. TERMINATION OF SERVICES
Capital Gainz Fitness reserves the right to discontinue services when appropriate, including for repeated nonpayment, unsafe or inappropriate conduct, or circumstances that prevent an effective coaching relationship.
Any outstanding payment obligations or unused prepaid services will be handled according to the applicable agreement and law.
14. AGREEMENT
By purchasing or enrolling in Capital Gainz Fitness services, the client acknowledges that they have had an opportunity to review these Terms & Conditions and agree to the terms applicable to their program.
